These Terms and Conditions govern the use of the website betterbahn.eu (the "Service") operated by PERIER sp. z o.o.

1. Scope and Provider

By using the Service you accept these Terms. If you do not accept them, please do not use the Service.

2. Service Description

BetterBahn is an independent tool that helps users find cheaper train connections in Germany using split-ticketing techniques.

What BetterBahn offers:

BetterBahn is not an official project of Deutsche Bahn AG or any other railway company. BetterBahn is a search tool and not a booking platform. All bookings are concluded directly with the respective official providers.

3. Free and Paid Use

The basic features of the Service are free of charge and may be used without registration. A free account unlocks additional features such as search history and saved preferences.

BetterBahn Pro is an optional paid subscription with two billing cycles:

Prices are stated in EUR and include any applicable VAT in accordance with the law applicable to the customer. The subscription renews automatically at the end of each billing period until cancelled.

Payments are processed by Mollie B.V. (Keizersgracht 126, 1015 CW Amsterdam, Netherlands) acting as a payment service provider. The contractual counterparty for the subscription is PERIER sp. z o.o.; Mollie acts solely as a payment processor and is not party to the subscription contract.

You may cancel your subscription at any time from your account page. Cancellation takes effect at the end of the current paid period; access to paid features is retained until then. We do not refund the remaining portion of the current period unless required by applicable law.

If a renewal payment fails, we may suspend access to paid features at the end of the current paid period.

4. Right of Withdrawal (Consumers)

Consumers within the meaning of the Polish Act on Consumer Rights (ustawa z dnia 30 maja 2014 r. o prawach konsumenta) have the right to withdraw from a distance contract within 14 days without giving any reason, in accordance with Article 27 of that Act.

To exercise the right of withdrawal, you must inform us ([email protected]) of your decision by an unequivocal statement before the 14-day period expires.

Loss of the right of withdrawal

Pursuant to Article 38 point 13 of the Act on Consumer Rights, the right of withdrawal does not apply to contracts for the supply of digital content or digital services where performance has begun with the consumer's prior express consent and acknowledgement that they will lose their right of withdrawal once performance starts. By activating BetterBahn Pro and confirming the corresponding statement at checkout, you give such consent and lose your right of withdrawal as soon as access is granted.

5. Invoicing

Sales are documented in accordance with applicable Polish law. Consumers may request the issuance of a VAT invoice within 3 months from the end of the month in which the payment was made (Article 106b(3) of the Polish VAT Act). Business customers receive an invoice automatically provided that a valid VAT identification number is supplied at checkout. Invoices are issued by PERIER sp. z o.o. and are stored in accordance with the applicable retention periods.

6. User Account

Registration of a user account is voluntary. During registration you must provide a valid email address and password. You are responsible for keeping your login credentials confidential. Paid features additionally require an active subscription and a valid payment method.

The Service is open to everyone. Persons under 18 should use the Service together with a legal guardian.

7. Acceptable Use

When using the Service, the following actions are prohibited:

We reserve the right to suspend or terminate accounts that breach these rules.

8. Disclaimer of Liability

We strive for high availability and accuracy but cannot guarantee uninterrupted operation of the Service. We assume no responsibility for the correctness or completeness of timetable and price information provided by third parties, nor for the content of external websites linked from the Service.

To the extent permitted by Polish law, our liability is limited as follows. Liability for damage caused intentionally (wina umyślna) or through gross negligence (rażące niedbalstwo), as well as liability for damage to life, body or health, is not excluded or limited. Statutory liability under the Polish Civil Code and the Act on Consumer Rights remains unaffected.

BetterBahn is a search tool, not a booking platform. All bookings are concluded directly with the official providers. We assume no responsibility for bookings, payments to carriers, travel disruptions or any consequences arising from the use of third-party booking systems.

9. Consumer Rights and Complaints

Consumers benefit from the protections of Polish consumer law, including the Act on Consumer Rights and the warranty rules of the Polish Civil Code (rękojmia, Articles 556 et seq.).

Complaints (reklamacje) regarding the Service or paid subscriptions may be submitted by email to [email protected]. We will respond within 14 days of receipt.

10. Privacy

The protection of your personal data is important to us. Details of how we process personal data are set out in our Privacy Policy.

11. Copyright

All content on this website, including text, images and design, is protected by Polish copyright law. Content may be used for personal, non-commercial purposes only. The source code of the split API is publicly available at github.com/kacperkwapisz/betterbahn-split-api.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced on this page. Continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not accept the changes, you may stop using the Service and cancel any active subscription.

13. Final Provisions

Applicable law. These Terms are governed by Polish law.

Jurisdiction. Disputes between PERIER sp. z o.o. and a business customer (B2B) shall be settled by the court having jurisdiction over the registered seat of PERIER sp. z o.o. (Szczecin). For consumers, the competent court is determined in accordance with Regulation (EU) No 1215/2012 (Brussels I bis) and the Polish Code of Civil Procedure; this provision does not derogate from the consumer's right to bring or be sued only in the courts of their place of domicile.

Severability. Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall not be affected.
